1. Nature of the Service
Elk River Residents Directory is a privately operated reference. It describes and links to public rolls, record indexes, and directory collections relating to Elk River, Minnesota. It does not host government records and has no affiliation with a government office, court, or records custodian.
2. Acceptable Use
Use the service only for lawful purposes. You may not use it, or material found through it, to:
- Stalk, harass, intimidate, threaten, or harm any person
- Locate someone protected by a restraining or protective order
- Commit identity theft or fraud
- Make FCRA-regulated decisions (credit, employment, tenant, insurance)
- Scrape, copy, or republish the site's content at scale
- Interfere with the site's operation or security
3. No Consumer Reports
This service is not a consumer reporting agency as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. Nothing on it, or returned through a linked search tool, is a consumer report and none may be used to decide eligibility for credit, employment, housing, insurance, or another FCRA-covered purpose.
4. External Resources
Government portals and third-party services, including sponsored search tools, operate under their own terms and policies. Their content, availability, prices, and data practices are outside our control.
5. No Warranty
The service is provided "as is" and "as available," without warranties of any kind. We do not promise that its content is accurate, complete, or current, or that a linked portal will operate or return correct results.
6. Liability Limits
To the extent allowed by law, we are not liable for direct, indirect, incidental, consequential, or special damages arising from the service or a linked resource, including decisions based on records found through a link.
7. Indemnity
You agree to indemnify and hold harmless the site's operators from a claim or demand, including reasonable attorneys' fees, caused by your misuse of the service or violation of these terms.
8. Intellectual Property
The site's original text, design, logo, and layout are protected by copyright. Linking and brief attributed quotations are welcome; republishing full pages or systematically copying content is not permitted.
9. Changes to Terms
We may revise these terms by posting an updated version here. Continued use after that posting indicates acceptance.
10. Access Restrictions
We may block or limit access, without notice, when a user violates these terms or abuses the service.
11. Governing Law
These terms are governed by Minnesota law without regard to conflict-of-law principles. Public-data requests to Minnesota government entities are governed separately by the Minnesota Government Data Practices Act, Minn. Stat. ch. 13, including the access provisions in §13.03.
12. Severability
If a provision of these terms is unenforceable, the remaining provisions continue in force.
